Service Agreement and Acceptance
By accessing and using GearRelay Japan's platform, you agree to be bound by these Terms of Service. Our rental platform connects you with premium sports equipment for tennis, skiing, and cycling activities. These terms govern your use of our website, mobile applications, and all related services.
Equipment Rental Policies
All equipment rentals are subject to availability and must be reserved through our platform. Rental periods begin when equipment is delivered and end upon return. Late returns incur additional daily charges. You must inspect equipment upon delivery and report any issues immediately.
User Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must provide accurate information during registration and keep your profile updated. Sharing accounts or using false information may result in service termination.
Payment Terms and Billing
Rental fees are charged upon confirmation of your booking. Membership fees are billed monthly or annually as selected. All payments are processed securely through our payment partners. Failed payments may result in service suspension until resolved.
Equipment Care and Liability
You are responsible for the proper care and use of rented equipment. Normal wear is expected, but damage beyond reasonable use will incur repair or replacement charges. Our optional damage coverage plans provide protection against accidental damage during your rental period.
Delivery and Return Procedures
We deliver equipment to specified locations including courts, resorts, and trailheads within our service areas. You must be available to receive deliveries at scheduled times. Returns must be made at agreed locations and times. Failure to return equipment may result in additional charges.
Cancellation and Refund Policy
Reservations can be cancelled up to 24 hours before delivery for a full refund. Cancellations within 24 hours incur a 50% charge. No refunds are provided for no-shows or unused rental periods. Membership fees are non-refundable but can be cancelled for future billing periods.
Service Availability and Limitations
Our services are available in designated areas across Japan. Service availability may be limited by weather conditions, equipment maintenance, or other operational factors. We reserve the right to modify service areas and equipment availability without prior notice.
Prohibited Uses and Conduct
You may not use our equipment for commercial purposes, illegal activities, or in ways that violate manufacturer guidelines. Subletting or transferring equipment to third parties is prohibited. Misuse of equipment or violation of these terms may result in immediate service termination.
Intellectual Property Rights
All content on our platform, including logos, text, images, and software, is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission. User-generated content remains your property but grants us usage rights for service improvement.
Limitation of Liability
GearRelay Japan's liability is limited to the rental fees paid for the affected service period. We are not liable for indirect, incidental, or consequential damages. Our maximum liability for any claim is limited to the total amount paid by you in the 12 months preceding the claim.
Dispute Resolution Process
Disputes will be resolved through binding arbitration in Tokyo, Japan, under Japanese law. You agree to attempt resolution through our customer service team before pursuing legal action. Class action lawsuits are waived in favor of individual arbitration proceedings.
Service Modifications and Termination
We may modify these terms, our services, or pricing with 30 days' notice. We reserve the right to terminate accounts for violations of these terms or discontinue services with reasonable notice. Upon termination, all outstanding obligations remain in effect.
Governing Law and Jurisdiction
These terms are governed by Japanese law and subject to the jurisdiction of Tokyo courts. If any provision is found unenforceable, the remaining terms continue in full effect. These terms constitute the complete agreement between you and GearRelay Japan.
